How to Get Your NC Arrest Records

If you’re like many people who have made a few mistakes in the past, you’ve probably heard about criminal record expungement, which requires you to get a complete copy of all your NC arrest records.

But where do you even find them?

This guide will show you how to get your North Carolina arrest records so you can begin the expungement process.

How to Get Your NC Arrest Records

Every county and city in North Carolina has its own process for allowing you to retrieve your records, but for the most part, you can get them from the agency that arrested you. If you were arrested multiple times, and in different counties, you may need to ask your expungement lawyer for help.

Your attorney may be able to use a report that comes directly from the North Carolina court system using the Automated Criminal/Infractions System, or ACIS. These records include information on every arrest and infraction, including:

  • Date of the offense
  • Date of arrest
  • County where the offense took place
  • Description of the offense
  • Disposition of the case (the end result, like guilty, not guilty or dismissed)
  • Date of disposition

What Will Your Expungement Lawyer Do With the Information in Your NC Arrest Record?

Your expungement attorney needs the information listed in your complete arrest record so he can petition the court to clear your record.

In order for the court to consider expunction, it needs information on each case attached to your name. There’s a specific petition your attorney must fill out to get the court to consider clearing your record, and it requires the dates important to your case, the location of your case and the final disposition of your case, as well as some other information.

The North Carolina State Bureau of Investigation and the North Carolina Administrative Office of the Courts will review your petition. The NCSBI will perform a state and national background check and provide the information it turns up to the court so the court can determine whether you’re eligible for expunction. The NC Administrative Office of the Courts will search its confidential database of expunction orders to find out whether you’ve ever had a record expunged before.
